Re: Scope of Tex. Educ. Code § 11.067 (RQ-0606-KP)

S U M M A R Y

A "vendor" under Texas Education Code subsection 11.067(a) is an individual or entity who enters into any agreement for the provision of goods or services with a school district. A vendor "receives a contract" under subsection 11.067(b) if it is awarded the opportunity to provide goods or services for a school district. The vendor must have sought the contract award, and a conflict of interest must be present for criminal liability to attach. But a vendor need not enter into a contract or participate in a formal bidding process to "receive" the contract under subsection 11.067(b). Whether a particular transaction would subject a vendor to criminal liability under subsection 11.067(b) requires the resolution of fact questions that are beyond the scope of an Attorney General opinion.

Re: Municipal authority over certain firefighter positions under the Texas Local Government Code (RQ-0609-KP)

S U M M A R Y

The Fire Fighter and Police Officer Civil Service Act authorizes a municipality's governing body to abolish civil service-classified positions in the municipality's fire department, but abolishment must be done in good faith. A municipality's civil service commission and department head have authority under the Act to vacate classified firefighter positions under certain circumstances, and they may fill vacant classified firefighter positions in compliance with the procedures set forth in the Act. The Act does not confer such authority to the Valley International Airport board or airport director.

Re: Whether a Type A general law city may accept a donation of property, including money, for municipal purposes (RQ-0613-KP)

S U M M A R Y

Subsection 51.015(a) provides Type A general-law municipalities with the authority to accept donations of property, including money, so long as it is done for a municipal purpose.
